CLUB NÀUTIC L’ESCALA offers through this website an online reservation service for moorings, activities and sports services, which is regulated by the following conditions:
Reservation and payment:
When the User wishes to confirm the reservation of any of the services and/or activities offered on the website, he/she must make the advance payment stipulated for each service through the payment gateway of the website at the time of booking or upon receipt of confirmation of availability, if applicable.
The rest of the payment, if applicable, must be made at the Club’s offices at the beginning of the contracted service.
In order for the reservation to be valid, the data provided must match the real data of the User who will do the activity. Before starting the activity, the User may be asked for accreditation in order to verify their data. In the event that these do not match or the User is not identified, access to the service may be denied.
In the case of providing the bank details, these will be entered in the computerized files of the Club Nàutic l’Escala to collect the fee established according to the request submitted. The invoices issued by the Club Nàutic l’Escala will be charged to the current account number that you have indicated to us and according to the maturities that appear on the same invoices and in accordance with the conditions established in your contract or request of services. Any modification of the data on this form must be notified to the Club Nàutic l’Escala. In the event that the receipt is returned by the contracting user of the activity, he must assume the bank charges generated.
Responsibility:
The User must take care of the facilities and the equipment provided to carry out the service contracted and will be responsible for their own negligent behaviour, whether this causes damage to things or injury to people.
The User accepts and agrees to comply with the rules and timetables established by the Port Management.
CLUB NÀUTIC L’ESCALA does not accept responsibility under any circumstances for any accident that any person may suffer during the contracted service. However, in accordance with current legislation, CLUB NÀUTIC L’ESCALA has taken out a civil liability insurance.
Cancellation policy:
If the reservation is cancelled, 50% of the advance payment will be refunded, provided that the cancellation is made more than 15 days before the start of the contracted service.
If the reservation is cancelled within the 15 days prior to the start of the service, no proportion of the advance payment will be refunded.
Data Protection
In compliance with the new EU regulation 2016/679 dated 27th April, we inform the User that their personal data is included in files owned by CLUB NÀUTIC L’ESCALA, whose purpose is the management of clients as well as the management of payment of fees, and any activity or service connected to the Club.
CLUB NÀUTIC L’ESCALA may keep users informed of all the services and activities provided that might be of interest via letter or any electronic means that the User has supplied.
The data will not be communicated to third parties except when required by a competent authority. However, the website may use third-party cookies in accordance with the Cookies Policy and the user’s consent.
When the User contracts any service from the website, the User grants free access of any right corresponding to his/her image obtained in photographs taken by the Club administration during the course of an event and authorises its publication in leaflets, magazines, social networks or the web page of the CLUB NÀUTIC L’ESCALA.
The User may exercise their right to access, rectification, cancellation, opposition, limitation of the treatment and portability, provided for in the New Regulation (EU 2016/679) dated 27th April, by sending a letter to CLUB NÀUTIC L’ESCALA, Port la Clota, s/n, 17130 l’Escala (Girona) and may revoke his/her consent to receive commercial communications at any time by sending an email to club@nauticescala.com.
Competent Jurisdiction:
These terms and conditions of contract are governed by applicable Spanish law, and unless the law establishes otherwise in the current regulations, including the consumer and user regulations, any dispute will be submitted to the judges and the Courts of Girona.
