Through this website, CLUB NÀUTIC L’ESCALA offers an online booking service for port services and nautical activities, which will be governed by the conditions set out below.
1.- Scope of application of the General Online Contracting Conditions:
They apply ONLY to bookings made online via the Web. They basically apply to bookings for the following services:
Reservations for annual, seasonal or longer than one month mooring services are expressly excluded from these general conditions. They have their own booking and cancellation policy and to consult them it is necessary to go directly to the Port offices.
These General Conditions are configured as complementary provisions to those already provided for in the Club’s rules and regulations, so that any doubt or contradiction that may arise between these General Conditions and the rest of the Club’s rules and regulations will be resolved by the Club Management, with the regulatory provisions taking precedence over any that may be contradictory.
2.- Port services for boats in transit and stays of less than one month.
Booking and payment:
To confirm the reservation of a mooring on the website, the user must make an advance payment, at the time of booking or upon receiving confirmation of availability. The rest of the payment, if applicable, must be made before the start of the contracted service, in accordance with the corresponding deadlines.
The data provided by the user and/or boat must be valid. Before the start of the service, the user may be asked to provide proof of the data provided. If these do not match or if the user does not identify him/herself, access to the service may be denied.
In the case of providing bank details, these will be introduced into the computerised files of Club Nàutic L’Escala in order to proceed with the collection of the established fees and services. Invoices issued by Club Nàutic l’Escala will be charged to the indicated current account number according to the due dates stated on the invoices themselves and in accordance with the conditions set out in the provision of services contract or request. Any modification of the data must be notified to Club Nàutic L’Escala. In the event that the receipt is returned by the user contracting the service, they must assume the bank charges generated.
Change and cancellation policy:
As a general rule, in case of canceling the reservation of the mooring of boats in transit or with stays of less than one month, 50% of the advance payment will be paid, as long as the cancellation occurs more than 48 hours before the start of the contracted service.
In the case of requesting a change in the reservation, this must be requested up to 48 hours before the start and may or may not be applied, depending on availability.
In the event that the reservation is cancelled or modified within the last 48 hours prior to the start of the service, the advance payment will not be refunded in any case or in any proportion whatsoever.
3.- Nautical activities
Booking and payment:
To confirm the reservation of any nautical activity on the website, the user must make an advance payment, at the time of booking or upon receiving confirmation of availability. The rest of the payment, if applicable, must be made before the start of the contracted service, in accordance with the corresponding deadlines.
For nautical activities, the rest of the payment must be made up to 7 days before the start of the activity at the latest. If payment is not received within this period, the booking of the activity will be cancelled and the user will not be entitled to claim the payment made on account.
The data provided by the user must be valid. Before the start of the activity, the user may be asked to provide proof of the details provided. If these do not match or if the user does not identify him/herself, access to the service may be denied.

Invoices issued by Club Nàutic L’Escala will be charged to the indicated current account number, according to the due dates stated on the invoices themselves and in accordance with the conditions set out in the application for the provision of services. Change and cancellation policy:
In case of cancellation of the booking, 50% of the pre-payment will be refunded, provided that the cancellation occurs more than 15 days before the start of the contracted service.
In the case of requesting a change in the activity, this must be requested up to 15 days before the start of the activity and may or may not be applied, depending on availability.
If the booking is cancelled or a change is requested within the 15 days prior to the start of the activity, the advance payment will not be refunded in any case or proportion.
4.- Responsibility:
The user must take care of the facilities and the material ceded to enjoy the contracted service, being responsible for the consequences derived from his/her negligent action, whether this causes material or personal damage.
The user accepts and undertakes to comply with the rules and timetables established by the Port Management, in accordance with the Police, Management and Exploitation and Internal Regulations of the Club. Consult them here
CLUB NÀUTIC L’ESCALA accepts no responsibility under any circumstances for any accident that any person may suffer as part of the contracted service. However, CLUB NÀUTIC L’ESCALA has taken out Civil Liability insurance, in accordance with current legislation.
5.- Data protection
In compliance with the new EU Regulation 2016/679 of 27 April, we inform you that your personal data are included in files owned by CLUB NÀUTIC L’ESCALA, the purpose of which is the management of customers as well as the management of the payment of fees, such as the management of any activity or service related to the Club.
CLUB NÀUTIC L’ESCALA may keep the User informed of all the services and activities it carries out that may be of interest to them by letter or any electronic means that you have provided us with.
The data will not be communicated to third parties except when required by a competent authority. However, the website may use Cookies from third party companies in accordance with the Cookies Policy and the user’s consent.
When contracting any of the services of the website, the User freely cedes any rights corresponding to their image obtained in photographs taken by the Organisation during the course of the event, authorising their publication in leaflets, magazines, social networks or the CLUB NÀUTIC L’ESCALA website.
Users may exercise their rights of access, rectification, cancellation, opposition, limitation of processing and portability, as provided for in the New Regulation (EU 2016/679) of 27 April, by writing to CLUB NÀUTIC L’ESCALA, Port la Clota, s/n, 17130 L’Escala (Girona) and may revoke their consent to receive commercial communications at any time by sending an e-mail to club@nauticescala.com.
6.- Competent Jurisdiction:
The present contracting conditions are governed by the applicable Spanish law and, unless the law establishes otherwise in the regulations in force including consumer and user regulations, any conflict will be submitted to the judges and courts.
